Form I-485 is used by individuals in the United States who are eligible to apply for permanent residency (a Green Card). This form allows a foreign national to adjust their status from a temporary or non-immigrant status (such as a student, worker, or visitor) to that of a lawful permanent resident (Green Card holder) without needing to leave the U.S.

Who Can File - Eligibility

1-Family-Based Adjustment:
If you are the spouse, child, or parent of a U.S. citizen or lawful permanent resident, you may be eligible to adjust status.
2-Employment-Based Adjustment:
If you have an approved employment-based immigrant petition (e.g., Form I-140) and an available visa number, you may be eligible.
3-Asylum Seekers:
If you have been granted asylum and have been in the U.S. for at least one year, you may apply to adjust status.
4-Special Immigrants:
Certain special immigrants, such as religious workers, may qualify.
5-Diversity Visa Lottery Winners:
If you were selected in the Diversity Visa Lottery, you can adjust your status to permanent residency if you meet the other eligibility requirements.

Requirements

1-Entry to the U.S.
You must have been admitted or paroled into the U.S. (you entered the U.S. legally or were allowed entry under a parole program).
2-Immigrant Petition Approval:
Depending on your immigrant category, you may need an approved Form I-130 (for family-based applicants) or Form I-140 (for employment-based applicants).
3-Visa Availability:
For certain categories, there must be an available immigrant visa number. Immediate relatives (spouses, parents, children) of U.S. citizens usually have a visa number available, but other categories may need to wait.
4-Physical Presence:
You must be physically present in the U.S. when applying for adjustment of status.
